            AN ORDINANCE FOR THE IMPLEMENTATION OF REPUBLIC ACT NO. 9257, OTHERWISE KNOWN AS “AN ACT GRANTING ADDITIONAL BENEFITS AND PRIVILEGES TO SENIOR CITIZENS AMENDING FOR THE PURPOSE REPUBLIC ACT NO. 7432, OTHERWISE KNOWN AS AN ACT TO MAXIMIZE THE CONTRIBUTION OF SENIOR CITIZENS TO NATION BUILDING, GRANT BENEFITS AND SPECIAL PRIVILEGES AND FOR OTHER PURPOSES” IN THE MUNICIPALITY OF CAINTA, RIZAL

 

                WHEREAS, Republic Act No. 9257 otherwise known as “An Act Granting Additional Benefits and Privileges to Senior Citizens Amending for the purpose Republic Act No. 7432, otherwise known as “An Act to Maximize the Contribution of Senior Citizens to Nation Building, Grant Benefits and Special Privileges and for other purposes”, was enacted by the Twelfth Congress to motivate and encourage senior citizens to contribute to nation building;

 

WHEREAS,  Section 4 (b) of Republic Act No. 9257 provides that:

 

SEC. 4 Privileges for the Senior Citizens. The senior citizens shall be entitled to the following:

                (b) a minimum of twenty percent (20%) discount on admission fees charged by theaters, cinema houses and concert halls, circuses, carnivals, and other similar places of culture, leisure and amusement for the exclusive use or enjoyment of senior citizens;

 

                WHEREAS, the Municipal Government of Cainta recognizes the importance of its elderly constituents to the continuous development of the Municipality and deems it necessary to provide an additional ten percent (10%) discount for admission fees in cinemas all over the municipality;

 

NOW THEREFORE, BE IT ORDAINED, AS IT IS HEREBY ORDAINED BY THE SANGGUNIANG BAYAN OF CAINTA, RIZAL THAT:

 

Section 1. All cinema/theater operators in the Municipality of Cainta are hereby directed to grant an additional ten percent (10%) discount on admission fees to all senior citizens as follows:

1. Monday and Tuesday – from second screening onwards;

1. Wednesday to Sunday – from first screening onwards; and
2. Holidays – from first screening onwards

 

Section 2. The additional ten percent (10%) discount shall be granted on top of the original twenty percent (20%) discount presently being enjoyed by the senior citizens.

Section 3. All senior citizens are hereby required to present their Senior Citizen’s Identification Card to avail of the discount.

Section 4. Penalty Clause. Any cinema/theater operator who shall fail to comply with the provisions of this ordinance shall be meted a fine of One Thousand Pesos (P 1,000.00) for every commission of the offense.

Section 5. Implementing Authority. The Office of the Senior Citizen’s Affairs and the Business Permit and Licensing Office are hereby tasked to monitor the implementation of this Ordinance

Section 6. Effectivity. This ordinance shall take effect fifteen (15) days after its publication.

ENACTED: JANUARY 18, 2010

AN ORDINANCE GRANTING FREE HOSPITALIZATION TO HEALTH GREEN CARD BEARING  SENIOR CITIZENS OF CAINTA, RIZAL WHO WILL BE ADMITTED ON EMERGENCY CASES AT THE BAGONG CAINTA MUNICIPAL HOSPTIAL (BCMH).

            WHEREAS, the President of the Republic signed into law on February 26, 2004 Republic Act No. 9257, known as “An Act Granting Additional Benefits and Privileges to Senior Citizens Amending for the Purpose Republic Act No. 7432, otherwise known as “An Act to Maximize the Contribution of Senior Citizens to Nation Building, Grant Benefits and Special Privileges and for Other Purposes”.

WHEREAS, Section 447 of the Local Government Code of 1991, provides that the Sangguniang Bayan, as the legislative body of the Municipality, shall enact ordinances, approved resolutions and appropriate funds for the general welfare of the municipality and its inhabitants pursuant to Section 16 of this Code;

WHEREAS, the Municipal Government of Cainta is committed to implement social welfare programs to promote the good health of its local constituents;

WHEREAS, among municipal residents, it is the Senior Citizens who are prone to various illness or diseases that needs emergency medical treatment and as such, they should be given adequate and immediate medical services to maintain their good health in their twilight years;

BE  IT ORDAINED BY THE SANGGUNIANG BAYAN OF THIS MUNICIPALITY, IN A SESSION DULY ASSEMBLED, THAT:

Section I. Duly accredited Senior Citizens of Cainta, Rizal who are Health Green Card Holders shall be granted free  hospitalization if admitted on emergency cases at the Bagong Cainta Municipal Hospital (BCMH).

Section II. The free hospitalization services to be given to Health Green Card  bearing Senior Citizen, subject to the guidelines to be issued by the Department of Health (DOH), in coordination with the Philippine Health Insurance Corporation (PHILHEALTH), are as follows:

1. Medicines
2. Examination (laboratory /medicine)
3. Doctor’s Fee
4. Hospital Bills
5. Minor Surgical Operations

Section III. Not included in the free medical services at the Bagong Cainta Municipal Hospital (BCMH) are the following:

1. Medico Legal
2. Chemotherapy
3. Dialysis
4. Psychiatric Case
5. Maintenance  Medicines on continuing sickness
6. Major Surgical  Operations

Section IV. The guidelines to determine if a medical service is on emergency case, or whether the operations is minor or major, shall be formulated by a committee to be composed of the following:

1. The Director of the BCMH
2. The Municipal Health Officer
3. The Chairman of the Committee on Health and Social Services of the

Municipal Council of Cainta

Section V. This Ordinance shall be effective immediately upon its approval.
